Terms of Service (NousBooks)

These Terms of Service (“Terms”) govern your access to and use of the NousBooks website, store, and any related content, tools, products, and services (collectively, the “Services”). The Services are operated by NousBooks(“NousBooks”, “we”, “us”, or “our”).

By visiting our site, creating an account, or purchasing or downloading any digital product from NousBooks, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1) Eligibility & Accounts

You confirm that you are at least the age of majority in your jurisdiction (or that you have the consent of a parent/guardian) and that you have the legal capacity to enter into these Terms.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may suspend or terminate accounts that we reasonably believe are being used fraudulently or in violation of these Terms.

2) Digital Products & Delivery

NousBooks sells digital products (e.g., ebooks, templates, guides, and other downloadable content). No physical goods are shipped.

After successful payment, you will receive access to download your digital product(s) via the order confirmation page and/or by email. Download availability and delivery method may vary depending on the product.

You are responsible for:

• Providing a valid email address at checkout

• Ensuring you can access and download files (including checking spam/junk folders)

• Maintaining compatible devices/software to open the files (e.g., PDF reader)

We may update, replace, or improve digital products from time to time. Unless otherwise stated, updates (if any) are provided at our discretion.

3) Pricing, Taxes & Payments

All prices are shown on the website at the time of purchase. We reserve the right to change prices at any time without notice. Price changes do not affect orders already paid for.

Payments are processed through third-party payment providers. NousBooks does not store full payment card details. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us (and our payment processors) to charge the total purchase amount.

Where applicable, taxes may be applied at checkout based on your location and relevant tax rules.

4) License & Permitted Use (IMPORTANT)

All digital products sold by NousBooks are licensed, not sold.

Unless otherwise stated on the product page, your purchase grants you a limited, non-exclusive, non-transferable, revocable license to access and use the digital product for personal use only.

You may:

• Download and use the product for your own personal learning and reference

• Store a copy for your personal use on your own devices

You may NOT (strictly prohibited):

• Copy, reproduce, or redistribute the product or any part of it

• Share, upload, email, post, publish, or make the product available to others (free or paid)

• Resell, sublicense, rent, lease, or commercially exploit the product

• Create “derivative products” for resale based substantially on our content

• Use the content in training, coaching, membership sites, paid communities, marketplaces, bundles, or similar commercial formats without our prior written permission

• Remove watermarks, copyright notices, trademarks, or any proprietary markings

Any unauthorized use, copying, or distribution is a material breach of these Terms and may result in termination of your license without refund and possible legal action.

5) Intellectual Property & Content Rights

All content on the Services (including text, designs, branding, graphics, logos, product files, and downloadable materials) is owned by NousBooks or used under lawful license and is protected by applicable intellectual property laws.

Some materials may be based on or incorporate content that NousBooks lawfully publishes under valid licensing arrangements (including Private Label Rights (PLR) or similar). Regardless of origin, the compiled product, presentation, and publication are protected, and your purchase does not grant any ownership rights.

You receive only the license expressly described in these Terms (or on the product page, if different).

6) Refunds, Returns & Chargebacks (Digital Goods)

Because NousBooks sells digital products delivered electronically, all sales are generally final once download access is provided.

However, we may consider refunds on a case-by-case basis at our sole discretion if:

• You were charged incorrectly due to a technical error, or

• You received the wrong file, or

• You cannot access the product due to a verified technical issue on our side that we cannot resolve.

Refund requests must be sent to hello@nousbooks.com within 7 days of purchase and must include your order number and the email used at checkout.

We reserve the right to deny refund requests where there is evidence of download access, misuse, abuse, or violation of these Terms.

If you initiate a chargeback without contacting us first to attempt resolution, we reserve the right to suspend your account, revoke access to products, and dispute the chargeback with the payment provider by providing evidence of delivery/access.

7) Product Information & No Professional Advice

Our products are educational and informational in nature. We make reasonable efforts to present accurate information; however, we do not guarantee that any content is complete, current, error-free, or suitable for your specific situation.

Nothing on the Services constitutes legal, tax, financial, medical, or other professional advice. You are responsible for how you use the information. If you need professional advice, consult a qualified professional.

8) Prohibited Conduct

You agree not to:

• Use the Services for unlawful purposes

• Attempt to gain unauthorized access to any systems or user accounts

• Interfere with the security or operation of the Services

• Scrape, harvest, or misuse content or customer data

• Upload or transmit malware or harmful code

• Engage in fraud, abuse, or harmful behavior toward NousBooks or other users

We may suspend or terminate access to the Services for any violation or suspected violation.

9) Third-Party Services & Links

We may use third-party tools and service providers (including Shopify and payment processors) to operate the Services. Third-party sites and services are governed by their own terms and privacy policies. NousBooks is not responsible for third-party content, policies, or practices.

10) Disclaimer of Warranties

To the maximum extent permitted by law, the Services and all products are provided on an “as is” and “as available”basis, without warranties of any kind, express or implied, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, or error-free.

11) Limitation of Liability

To the maximum extent permitted by law, NousBooks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Services or products.

Where liability cannot be excluded, NousBooks’ total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

12) Indemnification

You agree to indemnify and hold harmless NousBooks from any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Services or products.

13) Termination

We may terminate or suspend your access to the Services at any time if we believe you have violated these Terms, engaged in fraud, or misused our content. Upon termination, your license to use our products is revoked.

14) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest version. By continuing to use the Services after updates, you agree to the revised Terms.

15) Governing Law & Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws applicable to the operator of the Services, without regard to conflict of law principles.

Where required, consumers may also have rights under mandatory consumer protection laws in their country of residence.
